Flat rate dispute resolution is ideally suited for small, simple, or low value disputes. The model for such a system is the private adjudication system that the industry has adopted world-wide, as a precursor to modern statutory adjudication.

 

Here the parties would work with Mr. Glaholt to craft a short-cycle, time limited process designed to produce an interim binding resolution, all for a pre-agreed flat fee.

 

In the interest of economy, this process is ideally suited to “best offer arbitration” whereby, after negotiation, the parties exchange best offers and brief Mr. Glaholt. After a brief hearing and argument, Mr. Glaholt would then provide reasons as to which of these “best offers” should be chosen. Variations on this theme, including advisory opinions and documents-only Awards, are all possible.
